I sent an e-mail to Duke yesterday requesting that they expand their
standard permissions to allow the kind of use we're interested in.
After all, I doubt they've even heard of open source, much less
open-source music. I got the following reply today:

Your query has been received and forwarded to the reference staff of the Duke
University Rare Book, Manuscript,
  and Special Collections Library.  Because of staff shortages during 
the summer,
  there may be a delay of two to three
  weeks before we are able to respond. Thank you for your interest in our
collections.

Please let me know if you come across scanned-score sites that I can add
there. The Library of Congress site looks particularly promising, since
they don't put any conditions on the use of PD materials that they've
scanned in. It also seems to me that if one was really desperate for, e.g.,
a certain Scott Joplin score, it should be possible to go to the LOC and
make a photocopy. If there's anyone on this list who lives in Washington,
DC, now you know how to make yourself popular!
