Cipriano's body will be received by his cousin Cosme Fernandes from the GMC morgue on behalf of Cipriano's family on 7th.November, 2012 afternoon and shall be kept at his house at Povoacao, Moira, Bardez, from 1.00 p.m. before it is taken to the Moira Church for the funeral service and burial. The entire exercise shall be supervised and videographed by the SDM, Panjim, as according to the rules in force concerning custodial deaths. The following application to the JMFC, Panjim, by Cosme Fernandes is self-explanatory. MAY IT PLEASE YOUR HONOUR The Applicant Mr.Cosme Fernandes, cousin brother of late Cipriano Fernandes wish to state as under:- 1. That I have received the Order passed by this Hon’ble Court through the Aldona Police Outpost on 26 October, 2012, subsequent to the application made to this Hon’ble Court by Dr. Silvano Sapeco, in charge, Department of Forensic Science, Goa Medical College, Bambolim, Goa, regarding the hand-over of the body of Cipriano Fernandes which has been lying in the GMC morgue since his custodial death on 9/1/2011 and where the said Order authorizes the Forensic Department of the GMC to dispose off the body by observing all formalities for such disposal if the same is not taken possession by the kit and kin of late Cipriano Fernandes. 2. That in pursuance of the said Order, the kit and kin of late Cipriano Fernandes have decided to take possession of the body from the GMC Morgue to conduct the last rites and the burial there after. 3. That this decision has been arrived at UNDER PROTEST understanding that the ongoing investigation into the custodial death shall continue until the police personnel who have been indicted in the murder of Cipriano Fernandes while in custody shall be punished appropriately in accordance with the law of the land. 4. That all formalities of handing-over of the body to the kit and kin of Cipriano Fernandes whom I represent be carried out and all authorities concerned be informed of the hand-over of the body for final rites. 5. The date and time for the funeral service shall be fixed and intimated to this Hon’ble Court after all formalities of the hand-over to the body of Cipriano Fernandes are completed. 6. That suitable announcements be made by the concerned authorities to the media so that the people of Goa are kept well informed about the final rites of Cipriano Fernandes. Applicant Cosme Fernandes www.targetgoa.com Herald probe exposes blatant cover up May 8, 2011 TEAM HERALD PANJIM, MAY 7: The home minister’s shock, surprise and confusion when Team Herald confronted him with a straight query whether the Special Investigation Team was constituted to probe the Cipriano Fernandes custodial death case was not surprising. Herald first reported it in its February 26 Weekend edition (Home Minister played SIT card to delay action against Panjim cops,) and then again in its March 20 edition (When the lies come Home). On February 3, the home minister announced in the assembly a SIT headed by a senior officer Om Prakash Kurtarkar would investigate the actions of police officials charged with murdering Cipriano Fernandes in police custody. The next day, he prevented his own Home Department from recommending to the director general of police to take action against the accused police officers of the Panjim police station and wrote on the internal note, where this recommendation was made (again published by this newspaper earlier) “I have announced in the legislative assembly that SIT headed by Om Prakash Kurtarkar will be constituted and action against officials will be taken after submission of the SIT report.” As Heralds investigations have revealed there is no record of the Police Establishment Board transferring the case to the SIT. When the government decides to constitute a Special Investigating Team, the ideal process is that the Police Establishment Board headed by the DGP and consisting of the IG, the DIG, the senior superintendent of police and SP headquarters has to formally appoint an officer to head it. This is ratified by the Home Department and then sent to the Law Department. A formal notification is then issued. Importantly, the terms of reference and the time frame for the inquiry are clearly defined in the notification. In a reply to a Right to Information (RTI) query filed by social activist Jowett D ‘Souza, SP Headquarters V U Borkar said that no information of the Police Establishment Board meeting to transfer the case to SIT w as available. The only record of who will investigate the charges of murder, among others, of police officers of the Panjim police station, is this letter by DIG RS Yadav dated 9/02/2011. The letter states “The investigation of this case will be conducted by Braz Menezes PI under the direct supervision of Mohan Naik, SP of CB CID and overall supervision of O P Kurtarkar Supt of Police (coastal security)” Kurtarkar, the man who Ravi Naik said in the assembly was going to head the SIT investigations on the case, has admitted to Herald that he is there in his capacity as SP Coastal Security. The case is on paper with PI Vasco Braz Menezes who was deputed to the Crime Branch but is back in his old post of PI Vasco without relinquishing his position as head of investigations of the Cipriano case. JoegoaUk tries to piece it together but there are too many holes in everyone’s story. Summary: On 7th January 2011, his girlfriend dialled 100 to complain about Cipriano who threatened to kill her with a knife in his hand. Police arrested him at his Aunt’s residence at Porvorin around 10pm the same night. On 8th evening the police admitted to GMC after he fell down with a seizure. On 9th morning around 7, Cipriano died at GMC. Questions : Why did the police question him despite of the fact he was heavily drunk? They could have waited until next morning when he came to his senses. Why was the girlfriend present at the time of the arrest? Why did the police beat (as alleged by GF) the deceased and on whose authority or influence? Were they paid to beat Cipriano? Why beat him while transporting him in the jeep to the police station? Could it be for the money that the victim was carrying on him as alleged by his cousin? How did the cousin know the deceased was carrying Rs45000? Was the deceased already badly injured before the arrest? He was first thrashed by Caranzalem visitors, then he had a couple of accidents on the way to his aunt’s house in Porvorim. Beating or no beating, Panjim Police seems to be in serious trouble partly because of its procedural lapse. Now let us see what has been reported in various Goan dailies. You will see that different papers carry different news or opinions. News Reports: Moira Resident dies in police custody (NT. 11/1/11) According to SDM (Sub-Divisional Magistrate, Tiswadi) Shabaji Shetye Georgina Nunes of Caranzalem, girlfriend of the deceased Cypriano, stated in her complaint that the deceased had gone to her house at night with knife and under the influence of alcohol, so she called the police. Cypriano Canelio Fernandes (28) was arrested by Panjim Police under section 151 CrPC (Preventive arrest) at around 11pm same night. The next day (8/1/11) he fell down after he got a seizure and was moved to the GMC, Bambolim. He was admitted in ward no. 146 for treatment. He died at 6.45 the following morning 9/1/11 He also informed that statement of his wife, brother and cousin is being recorded in the office of SDM. Herald dated 12/1/11 “They started beating up Cyprian even as he was loaded in a police jeep. I had filed a complaint against him because he had threatened me, but I had never thought that he would die due to police beating’’ said Geogina Nunes, the girlfriend. GT 12/1/11 Georgina informed that police had started assaulting him from the time he was taken to the police station in their jeep. After he was brought to the Police station, he was later taken into the interrogation room inside the police station. The door was locked and she heard him being assaulted by the police inside the room. TOI 11/1/11 Oswald Cordeiro, a friend of the deceased said ‘Cipriano was working on a cruise boat and was to leave Goa on 19th to join work. He and his girlfriend had some altercation and he was arrested. Cipriano has never suffered from epileptic fits. He was working on a ship and this proves he could not be suffering from epilepsy. Custodial Death NT Network dtd 17/1/11 Cypriano Fernandes from Moira-Mapusa, who died at the GMC while in Police custody, was allegedly beaten by some villages of Caranzalem, before he ran to his relatives in Porvorim, from where the police arrested him. This was revealed by a source in the Police Dept. who also said Cipriano was under the influence of alcohol when he reportedly threatened his girlfriend at Caranzalem with a knife. The source said that soon after the threatening incident, some villagers who were in the vicinity mercilessly beat Cypriano. In the mean time the girlfriend called the police and Cypriano went to his relative house in Porvorim. TOI dtd 17/1/11 Cops robbed Cipriano of Rs.45,000: Family The family of alleged Custodial death victim Cipriano Fernandes has claimed that Cash around Rs.45K, an ATM card and one of the two mobiles were stolen while he was in police custody. Cypriano’s cousin Cosme Fernandes has alleged that the victim was beaten up so that the police could render him unconscious and then rob him of his belongings. Cosme also claims to have pictures taken by Cipriano on his cell phone while in police custody that show paint from the wall on the victim’s head. When the victim’s articles retuned to his Cousin Cosme, his ATM card. Nokia Mobile Phone and cash was missing. He said that Cipriano’s wallet contained only Rs.160. Cosme reasons that Cipriani was earning around Rs.1.80 lakhs per month (as Second Chef on a cruise liner abroad) and as such Cipriano could not have been roaming with only Rs.160 in his wallet. “When I went to collect his belongings, one of the policemen recovered Cypriono’s articles from the policeman’s personal scooter and not the police locker,” Cosme alleged. According to TOI investigation (dtd TOI 18/1/11) Cypriano informed police that he suffered injuries and could not walk after he met with an accident on the bridge a few minutes before he was picked up by the Police from his aunt’s housee at Porvorim on January 7 night. Police failed to take him (Cypriano) for medical examination. That Cypriano had met with an accident was confirmed by his aunt Rosy Fernandes 60, from whose house the police picked him up. Rosy in her statement to Panjim Police said Cypriano had told her that he drove his scooter in a rash and negligent manner while coming from Caranzalem and fell down near her residence and was unable to walk. She also said that he complained that he had dashed against a truck at Mandovi Bridge and sustained some injuries on his body while coming to her house. Navhind Times dtd 19/1/11 pg.16 Rosy Fernandes, a relation of the deceased Moira resident, has also told the authorities that he was aggressive on the day of his arrest and had created a scene when he came to her house forcing her and her granddaughter to move out of the house and that they returned to the house after Cipriano was taken away by the Police. Interestingly, Cosme Fernandes, a cousin of Cipriano, had lodged complaint with Mapusa Police on Dec. 30, 2010, stating that the deceased was harassing everybody in the house and that his behaviour was aggressive. He has asked the police to arrest the deceased person so as to protect him and his family. Based on the complaint the Mapusa police had booked Cipriano under section 155 of the Criminal Producure Code and produced him before the sub-divisional Magistrate, where he was bound over of good behaviour and released on bail of Rs.5,000 and one surety of like amount. Viscera sent to Surat Forensic Science Laboratory on 14/1/11 The report of the findings expected by end of the month. NT TARGET GOA adds: The doctors at the Forensics Deartment of GMC insist that there were only minor injuries on Cipriano’s body which could have been contracted during his seizure and not necessarily through beating. They dismissed reports of injury to Cipriano’s genitals. He had no major injuries said the doctors. But the scan did show and infarct in his brain. The media is agog and following every lead intently. If the cousin is lying, he has managed to fool a number of media houses, to take up the death of Cipriano as custodial killing. All talk of police beatings does not hold water since the doctors at GMC say Cipriano was not hit. The aunt said Cipriano had fallen outside her house in Porvorim, yet she says he was harassing her and he had to leave the house with her daughter. If the police did not use force on him, then all the dramatic coverage of the “custodial death” is going to look pretty foolish.
