Out of curiousity, what's the distinction? Is it related to load or something else? I ask because I'm considering using the Audit API fir something that is not related to legal compliance but is still within our rights under the terms of our agreement with Google and is permitted under our local security and privacy policies.

Setting the includeDeleted option to true only archives mails from the current Trash folder for auditing, it will not restore those mails that have been permanently deleted from the user's mailbox. Let me remind you, however, that the Audit API is meant only to serve official legal audit requests on your domain. For all your regular archiving needs, try Postini <http://www.google.com/postini/>.
