Term 9.1 is explicit about public availability. Term 10.11 is explicit about batch geocoding services. Yes, I think so. In particular your application fails against 9.1. Because you're using Google Earth, you may be able to persuade Google to vary your Premier licence by giving written permission to vary Term 10.12.
