Well, as long as we're messing with core code, here's a quick and
dirty hack. Find the line in multiSelectTag that reads:

if(includeNew)

replace it with

if(includeNew && tag != "Action")

Voila! No more New Action...

As for the "dependent action" problem, could you create a dependent
action off of an action in a project and see what tags it is getting?
If it's not being created with the original action as its tag, that's
where the problem is. Either a mistake in the code or you don't have
TW >= 2.4.3.
