To use the symbol, copy it to the directory:

(yourhomedirectory)/gvSIG/Symbols

In my case (windows7): C:\Users\Fjp\gvSIG\Symbols

is there a way to solve the problem of wrong rendering if exporting to a
ps or pdf?

The legend symbols look wrong.
