There are ways to make source code available to end users while maintaining
proprietary rights to software.  Some companies hesitate to do this,
however, because there are some who seem to feel that they are above the law
and will steal the code for their own profit.

In an ideal world with no greed and no lawlessness, this would not be an
issue.

No, its an issue of the GPL versus copyright licenses which prevent the
user who is individually licensing rights from being a full partner
with  source code and the working tools.  This has nothing to do with
the public domain, which is virtually gone anyway.  As for any
particular companies right to continue work and copyright, and then
release it restrictedly, its certainly a legal right.  Its not a good
thing, but you legally have that right.
