Dear Hasafranim, I would like to update you on an interesting provenance case currently unfolding in Israel:
A judge of the Magistrate's Court in Beit Shemesh issued today a temporary injunction prohibiting the sale of "Notebook 13" of Rabbi Abraham Isaac HaCohen Kook, which had been scheduled for sale at the "Nakdimon" auction house. The injunction was granted at the request of the Mercaz HaRav Institute, represented by attorneys Meir Heller and Keren Abelo, on the grounds that the manuscript was removed from the Institute's custody unlawfully approximately 20 years ago. The notebook, comprising 374 densely written pages, documents the early period of Rabbi Kook's life in the Land of Israel in 1904, and had been offered for auction on the Bidspirit platform. Following the issuance of the injunction, the sale was canceled, and the court has scheduled a hearing for tomorrow to examine the claims. At this stage, the order prohibits any transfer or action regarding the item until a decision is reached. The Mercaz HaRav Institute claims that the notebook had been entrusted to them by the heirs of Rabbi Zvi Yehuda Kook for purposes of research and publication. After a printed edition was produced in 2004, it was placed in storage at the Institute's offices in Jerusalem. According to the Institute, the disappearance of the manuscript was discovered only recently, when they came across its listing online.
