The only time a "re-issue" is covered under copyright is if:
1 - The re-issue has been edited significantly.  A publisher may
copyright for something as simple as only an added breath mark, but it
would be EXTREMELY hard to prove such an edit off of a recording or
performance.  Thus, most will only go through the copyright process for
significant edits (adding back missing portions such as the extra hammer
attack and brass exposition in Mahler 6).

2 - The re-issue is actually an arrangement.

A copyist may not re-issue copyright if all that has been done is to
duplicate the work and "recopy" it.

In this case, I am not aware of any existing copy of the original
version of Leonore 3 which is covered under any copyright and I have
done some checking on that.

This might not be true.

Certainly the music itself is not under copyright, but each new setting
of the parts may establish an independent copyright on that setting.
