As I've said before (and may yet say again) IBM simply cannot cut software charges across the board. The net margin hit would be intolerable. So there have been (and will be more) contrived schemes to try and add new workloads to zSeries without impacting existing revenue streams. z/OS.e was arbitrarily limited to eight TSO users so that it didn't impact "normal" z/OS. It may will be that you have a situation that IBM's lawyers didn't foresee. To be frank, I'll bet they're surprised by the sun coming up every morning. The description of sheep being surprised by trees in Douglas Adams' "So long and thanks for all the fish" comes to mind. I know some of these people. Present your well thought out business case to your local IBMer.
