If your contract says that your equipment, operations, etc. are managed at the new data center by the outsourcer's people, then you probably pay the software license fees. If your contract says that your system will be migrated into their environment... Now the licensing of software is based on the outsourcer's equipment... So your charges will include your "pro-rata" share. I have seen both situations used by the same outsourcing company.
