If this is the case, then it's inexcusable on both sides.
I don't know what penalties are in the US, but violating an NDA is a major 
issue if done in Canada.

Also, how can somebody be clueless about what's available and be doing an 
effective job?
I'm still unemployed, and I am aware of the current technology.
(I have to prove it in job interviews)
