Hercules cannot be "bought" in that sense of the word. It is distributed under the QPL. IBM could, of course, hire the developers and create a commercial "fork" in addition to stopping all other development by the current developers (if they become IBM employees). But that cannot stop other developers from continuing the "public" Hercules development (short of lawsuits, of course).
