I am not a lawyer, but as a layman I would expect the patent laws to
stipulate a fee for which anyone can access the innovation and use.

Software,  yes. If they are distributing software (embedded or otherwise),
they better make the source code available so that user can be free of
vendor dependence.

GM, TATA or Maruthi cars can be serviced by third party mechanics. Only with
open source software similar servicing can be done for the software driven
components.
