Very interesting insight...yes...it does seem that this budget has put
packaged software almost at par with customised software development
(services) w.r.t. taxes.

I was a bit unsure if it would affect open source brands like Red Hat and
Novell, since they sold service license with seemingly packaged software,
but Amit Boraskar (at Red Hat) has clarified that Red Hat typically sells
support services and hence pays service tax only.

I am trying to talk to other OSS players (and some from the proprietary
world too) to try and further update on this issue.

Subject: [ilugd] FOSS Friendly budget 2008?

Hi,

I was just wondering if this budget is FOSS friendly
indirectly. Excise duty on packaged softwares is
raised to 12%.

Now, considering most of the FOSS deployment in India
is provided as a service either by individual
consultants or companies, which invites a service tax
of 12.5%.

Any ideas?
