No problem; misunderstanding.

Look at the specs for the drive, that's the limit.

I have a Sony CRX140E I bought over a year ago; it's 4/8/32
Which means that it rewrites at 4x, burns at 8x, reads at 32x. Last time I
looked 16x burning was becoming standard.
So I imagine the 12x you report is the rated speed of your drive.
The disk may be rated at "up to 40x", but that's only if you have a drive
capable of doing that, and I doubt anything a home user can afford does yet.
