Probably depends on how you have worded your TOS.
We do make users aware when there is a threat of trojan,
virus, etc that may threaten the operation of their computer
and inform them that we are filtering any mail containing
signs of such viruses, etc to prevent delivery.  But we also
throw something in there along the lines of Service (including
delivery of electronic mail) is not guaranteed to be uninterrupted
or without error.

Ethically?  I delete it.  Legally?  There again, depends on your
TOS.
