Hi .. I apologize for offending you.. The premise was something else I was discussing which is true in many instances.
As for the case I mentioned.. I was in Baton Rouge, Louisiana at the time in 1980 and this case was in the news- I never forget the case since I was following it everyday. Even if we are to argue the merits of that case- I am sure we can not forget the case with the hot coffee and the McDonalds. Is that any difference? One buys coffee, one pours coffee on herself, one burns herself, one sues McDonalds and one wins! Wasn't there a Seinfeld episode about this? This is one case that as a company we have to concern ourselves with its many facets and ramifications. SPAM is just one case, viruses are another. In my e-Mail I was pointing out some subtleties that one has to consider and nothing is black and white. I added a little true case study for a side-track! We all run risks of getting hit with legal suits and in corporations we are always guilty until proven innocent- why? Because when we are sued we have to spend money to defend ourselves and there are lawyers out there that pick up work only to get paid when they win! So we end up defending ourselves & spend all the money to prove our innocence. So at the end we are penalized and when the case is settled and we are proven innocent we are out 20-30K for the smallest of cases. So if an employee decides to sue for a SPAM he did not receive or who knows what we as corporations can end up spending a lot of money for no fault of our own. I only wish we could have the European system that I believe passes the burden of expenses to the losing party (I could be wrong but I think that was the case the last time I read about it!). This problem is a lot bigger than you can imagine for those of us that have to sign the checks! I am confused where you got American bashing in this?
