John,

If you will call Microsoft at 1-800-426-9400, then select option 4, then 3,
then 2 you can then inquire about Ipswitch Imail running under Microsoft
Windows Server 2003 Web Edition. You will discover it is an approved
application for Internet use.

All components contained in Imail are already included in Windows Server
2003 Web Edition with the slight exception of IMAP, but nobody including
Microsoft has raised that issue. Microsoft can not legally require you to
use exclusively their brand of any component, or subset of components under
the Antitrust Agreement they entered into with the US Government. If you
want to verify that you can call your attorney.

This exact issue has already arisen with several other mail server providers
and Microsoft has clearly issued their position that as long at the mail
server is for Internet use it is an approved application. If it is for
enterprise, or intranet use it is not approved. Simple.

There are already several major email providers using Web Edition as their
base OS. They were on the forefront of the clarification of the licensing.
Microsoft's own statement is:

"Windows Server 2003, Web Edition Usage Rights.
The Server Software may be used solely for deployment of Web pages, Web
Sites, Web Applications, Web Services, and POP3 mail serving."

Pretty clear to me.

-Joe
