To give him the benefit of the doubt he didn't mention the state of his Symantec licensing.
My understanding had always been that IMail AntiVirus came with an annual licensing fee, and that you couldn't even run it after a year without renewing (even without updating the virus definitions). All their web site said was "IMail Anti-Virus provides 12 months of virus protection."
Therefore, downloading virus definitions without paying Ipswitch would almost certainly violate the licensing agreement, and running IMail AntiVirus after the year expired would probably violate the licensing agreement. Of course, without seeing the actual license, it is impossible to say for certain.
