Regarding to this point of view, it could not be covered or distorted according to the political will of the governments which in their rethorics highlight the sovereignity of law, but in practical field they blow up the universality of the principles of International Law. One of the too many governments with reactionary character that always shows its unrespect to International Law and the Human Rights principles, is the government of Indonesia and its Army Forces as its best playmaker. East Timor question, in its essence, is one of the International Question ! It is one of the Fundamental Human Rights question "par excellence" ! The violation either covered or uncovered against the Fundamental principles of Human Rights with its arguments could not be accepted, and the only word always emerged in the history of Human Kind was : FIGHT ! If there is a Resistence either in political sektor or military sector, the victims should be unavoidable; The unjustice should be the one standpoint for the authoritaristic government to resist alive. It's the point of the justification of the practices of the New Order Regim and, and it seems to be practiced again by the Reform Order Regim ! Even it's hradfull to each regim which hold up the manipulation and iron hand to keep it alive, soon it will blow down ! In this case, the New Order Regim has already experienced what it has brought ! The decline of Soeharto Regim signed the new era to all oppressed people. Specially to Mau-Bere's People ! It'a great victory to those who fight on behalf of Human Rights, democracy and justice ! Since Habibie is in power, East Timor question, step by step, but certain, it begin to upbring and attracts the attentions of many sectors - components in the community of Indonesia ! The presence of Komnas HAM as an Institutions of Human Rights Defence in case of upholding the question of East Timor has not to be like this, bat also to emphasysis that Komnas HAM has to be more brave to voice on behalf of Humana Rights, demokracy, justice adn peace without be trapped by the waves of manipulation of the New Order residuous ! When we heard that Komnas HAMdialogued with Xanana Gusmao, "some Leaders" of East Timor - eventhough none of the member of SPT was heard -, and took the iniciative to build up a Peasce Commission as an Institution in order to create a climate of peace in East Timor,, we are not only satisfied but also we think that it's a time to prove again "THE INTEGRITY OF KOMNAS HAM" ! Once again, we - eventhough is not heard byKomnas HAM in the concern of our life, ous suffering and our future - with our whole heart declare that we welcome and support every iniciative of Komnas HAM ! Its independency ! We state that the integrity of Komnas HAM has to be proved because we are expecting that Komnas HAM in the realiazation of its duty in East Timor has to keep itself hearing all parts without any pretention and has to jighlight the value of justice and true. Without this posture, Komnas HAM will turn itself as the tool of ABRI for a certain objective ! We hope, it shouldn't happen ! In order to support and to prove Komnas HAM, our Party recommend to Komnas HAM to makes whatever efforts to free : 1. Xanana Gusmao, East Timor Resistence Leader; 2. Shalar Kossi and his comrades detainned for more than 18 months at Austrian Embassy and it seems that Austrian Embassy made the detainnees uncommunicable as a form of pressure in order to leave the Embassy by themselves. It's because Austrian Embassy wants to avoid its concern with ABRI ! It's a form of Human Right violation. How Komnas HAM should appreciate this situation ?; 3. All political prisionners of East Timor (see: the list of the enclosure sheet). By the point of view of our Party, Komnas Ham has to care with the above recommendation, because by the essence that : 1. We shouldn't talk about PEACE and shouldn't creeping out only on behalf of superficial interests since in the meanwhile, those who were involved in the conflict of East Timor that we want to pacificate still suffering, still being persecuted, AND IRONICALLY, still being detainned behind the iron jail just only because they fight for the true, just only because they fight for Human Rights that are integral part of themselves either as personal or as the community of a people - nation named MAU-BERE ! 2. We can only materialize the climate of PEACE if we really appreciate the justice. All the product of Law of New Order Regim has to be ABOLISHED , because all product of Law of New Order Regim were full of manipulations, full of the practice of conspirations that according to us, are the cause of disastrous conflict in East Timor ! 3. The PEACE that we want to materialize in East Timor as the condition to step forward to solve East Timor Conflict has to be a considerable starting point of view that's not only presented in theory or in press statements but also has to be cared and involved all parts inclusively the low-illiterated class even personnally we feel unfortuned by their existence-presence ! 4. The PEACE shouldn't be settled out of the context of justice and honestity ! Because it will die before it springs and the conflict will extend in a wide-range ! 5. The PEACE has to be able to handover to each one the self valorization, the honor and estability that were taken away from him ! 6. The PEACE shouldn't only mean a phisical condition where there isn't army confrontation, there isn't brutal and phisical contact among groups but it should be the spiritual-mental-psycological conditions of calmity-estable-peace that can be enjoyed by each person of Mau-Bere's people, rich or poor people, famous or unfamous entities ! The essence of PEACE is fraternity, and fraternity means mutual recognition-mutual respect ! 7. And , specially, the PEACE shouldn't be the target of a manipulated objective condition to trap people's political conscience ! Our Party convinces that all political prisonners, all the persecuted people in political concerns have to to be released because : 1. All the basis of judicial condemnation are irrelevant since Indonesia Republic itself recognize East Timor as political and International Law question ! 2. The Republic of Indonesian and ABRI, in their political policy changing, to try to resettle themselves as netral parts in East Timor question and they seem to charges the conflict on the prointegrationists' shoulders. In accordance with point 2 cited above, our Party emphasyses that this posture could be accepted and all law implication of the past will be abolished as the political compromission if Indonesian Republic release all East Timor Political prisonners. 3. As a victims of this struggle, they have to be involved to support the implementation of PEACE in East Timor ! We hope Komnas HAM should take care of everything we presented above. Thanks a lot !
