"Admittedly, there has been a request from the DPR (House of Representatives) to promulgate such law immediately," Minister of Law and Legal Affairs Prof. Dr. Yusril Ihza Mahendra said on Sunday. The DPR passed the bill on controlling a state of emergency into law in 1998 when BJ Habibie was president. But the government has since suspended the law following waves of student demonstrations. "Judging from the latest developments, such as rampant riots, we deem it very necessary to provide the TNI (National Defence Forces) with a legal basis to maintain (peaceful) conditions," he said. In view of strong opposition against the law in the past, there was need to familiarize the people with the law now, he said. "Therefore, tomorrow the government will give a suggestion and response to the DPR`s request for a promulgation and revision of the law," he said. Unless the new law was imposed immediately, the government would apply Law No. 23/1959 which carries heavier punishment to handle various conflicts in the country, he said. He said the new law did not recognize the term "civil emergency" as prescribed in Law No. 23/1959. Rather, it used the terms "special state", "state of emergency," and "state of war." "A special state is imposed in the event of a riot difficult to control by ordinary ways so that (the concerned region) needs to form a special council led by the governor, the chief of the military district command, or the chief of the district police, to control the situation," he said. Any region would be declared in a state of emergency in the event of a rebellion against the legitimate government, he said. A state of war would be imposed if a foreign country has invaded Indonesia, he said. "So, the term "civil emergency" is no longer found in the new law," he added.
