there is a similar thread currently ongoing on this mailing list -
are you sure that you do not have a cron job or something spawning
instances of Apache periodically?

if you do a "netstat -a" (or its Linux corollary) you may see if a process 
is connected to a particular port - look for the ports either Apache or JServ 
is listening on.
