Possibly IBM filed some sort of amicus brief (is that even the right term when its not a lawsuit?) to the EU to state that IBM thought the EU wasn't handling the oracle/sun aquisition properly.
At any rate, while one could technically consider that supporting the deal, that's clearly not what IBM really wanted, so, yeah, well spotted inconsistency.
