Why? Because the Great Seekrit Cabal of Monocle Wearing Lawyer-Kings would forbid it? There are hundreds of thousands of lawyers. One of them will take your case and keep mum about it.
Its not frivolous unless someone can prove you're intentionally sabotaging your case. With the vagaries and complexity of the (US) law system being what it is, I'm sure you can sabotage it in a way thats not beyond reasonable doubt*. This is basically the same idea that some of us thought Paul Allen was doing: I'm suing for an ulterior motive (in his case, presumably to prove the current patent system is a mess), but I can't actually say that, as that would constitute proof that I'm doing it intentionally. *) I'm guessing barratry / contemptuous treatment of court is a criminal and not a civil offense.
