I upgraded ImageMagick to 6.3.4 in the SFW gate about 6 months ago.  At 
the time, I had an OSR and ARC review done.  The SFW build applies a 
patch to the source so that we don't have to ship the libtool ".la" 
files for the loadable backend modules.  Buried in the code, it looks 
for libtool ".la" files to find loadable modules instead of just using 
the module itself.  I suggested a patch that was more generic a while 
back, but was politely told "no thanks", so I created a simplified patch 
for Solaris.  As for encumberences, I don't recall there being any with 
ImageMagick.  The latest GhostScript is out for Legal review and it's 
taking a while, presumably due to some patent claims and a license grant 
to comes with them.  The other thing that was likely to be encumbered 
was foo2zjs, which may implement some active patents and doesn't supply 
a license to use the patents.  That's why I haven't bothered to try to 
include it in Solaris.
