I think you can always state that the workplace is a smokefree
environment, can't you?

If employees have to be responsible for customer owned equipment or
deliveries, there may be some bonding or other insurance requirement (or
you may want to consider adding something like that of your own). If so,
surely you can state that applicants must be able to pass whatever
qualifying check that requires.

I do believe you need to consider the wording carefully. It probably
deserves some legal review. Maybe the state has some advisory info for
employers?
