Many of the arguments also assume owners are sufficiently sophisticated to secure their wireless.

Again, we don't allow people to use anything in your house simply because you aren't nimble enough to operate locks.

And, yes, I realize that the analogies are all imperfect in some way. Wireless is something which actually extends beyond your house and doesn't require trespass to utilize. In addition, using bandwidth doesn't really hurt the owner of the AP in 99% of the circumstances where the AP is open.

That having been said, given how easy it is to wind up on the wrong access point nowadays(of the 18!!! access points I can see, 5 are open), making it a crime is a bit crappy, too.
