Well almost..  If the FL had been allowed to use the exceptional 
circumstances clause then Pearson would have won -if he had bid. Bates faced 
defeat at that moment and he would have been left with nothing and with a 
big financial loss.
That is why the exceptional circumstances clause had to be stopped at all 
costs and I strongly suspect that it was stopped (at all costs).
