Easy one this. On a technicality it can be deemed to be racist.
1st February 2007, the House of Lords gave a decision on the case of R v
Rogers
The definition of racial group in Section 28(4) of the 1998 Act clearly goes
beyond groups defined by their colour, race or ethnic origin. It
encompasses both nationality (including citizenship) and national origins.
A case was recently in court (not the one where I sit) where the defendant
recently pleaded guilty to a Racially Aggravated Section 5 Public Order Act
offence. The facts were that he had called a police officer a 'fucking
Scottish cnut'.
He might well have been a cnut, and then it would be fair (if not lawful) to
point it out. But it seems you can't go about calling people Scottish (even
if that is also true) as it is deemed discriminatory.
I think that MacPherson (but I could be wrong) defined a racist incident as
one where anyone perceives it to be racist, hence huge amounts of police and
judicial time being wasted on 'racist' incidents.
