The principle isn't complicated but the practice is.

Not everything merits copyright/db right/contractual protection. If 
Google steals one street name from OSM, I suspect there isn't a single 
major jurisdiction that would consider that actionable. If Google 
steals 5,000, most would. The challenge is drawing the line, 
both qualitatively and quantitatively.
