For a definitive answer this should probably be run by Red Hat's trademark counsel, but my thought is that merely publishing such a kickstart file on a blog or Github gist would not require trademark permission. But if it's part of some larger effort to create and distribute a Fedora derivative, the requirements relating to branding of Fedora remixes should be followed.
