it may be annoying, but if you are a subcontractor, you always have to hand 
over the code, ( i thought).

even if you have a direct contact with someone, the debate is  what you are 
selling,  if you are selling the source with the finished product, you 
should draw a contract with this specified.  if you are selling the finished 
product directly, you don't need to show your methods.  if you are selling 
your time to a middle person, you definitely should give the source code, 
because the actual client is not dealing directly with you and you may not 
be on intimate terms with the contract they signed with the people who are 
paying you.

the point is, and it's sharp - i know, i've been stuck with it - get the 
information up front.  if you have a contract ahead of  time, everyone is 
happy because they  know where they stand and there is no ambiguity.  if not 
- then you are asking for trouble.  when you make a stand for your rights 
after the fact, you probably won't have any.
