Linking by definition cannot make a piece of software derivative.  It is
in being literally "based on" the other work.  Unfortunately, software
has a functional nature, as well as artistic integrity, so being "based
on" becomes problematic.  The FSF believe that it includes writing a
program which calls code in a library.  This makes the program
derivative of the library, because the only reason anyone has for
obtaining this software, in general, is because of its functionality.
Therefore, to allow the author of the program to potentially profit from
the functionality of the library is contrary to the purpose of
copyright.

The software becomes derivative when it is written, not when it finally
physically combined with the library, through whatever means.

Because they're not the ones who made the rules about what constitutes
"derivative works", though they are the ones who are applying it.  The
law allows just the case you claim: infringement without a literal copy.
If you disagree with how they're applying it, which is to say that a
program is derived from the libraries it uses, you have merely to show
in court that it is not valid.  But the lack of legal precedent leaves
you constantly befuddled about it.  Leading to your desire to deride
those who feel they understand it well enough to consider it quite
reasonable.

That's because the default monitor is faulty.  I tried TaskManager2000
and it shows the various processes as either idle or a very small (<1%)
use.  Even the MSCEs acknowledge this point.

the "strings" command finds embedded strings in ANY file, including
compiled executables and dll files.

"Copyright (C), Regents of the University of California" strings have
been found in Mafia$oft's DLL files.

Actually, I liked the VAX-11 instructions set, becuase a good portion
of the standard C library functions could each be implemented as a single
line of assembly language...meaning that all of these things (like
strchr()) were executed at the microcode level.

The problem is, no compiler writer ever took advantage of this, which
is truly a pity.
