Lets forget IBM for a minute and imagine this scenario:

Company A produces a program (released under GPL) called: XYZ
Company B doesn't like company A product and they declare in the media that 
XYZ has some code that is violating patents or copyright.

Company A check their sources, and they conclude that company B is lying 
throught their teeth.

Company A has the FULL rights to sue Company B for "Tviat Dibah" and can ask 
for potential damages money from Company B - if Company B doesn't show any 
proof with a certain time frame.

Same issue here - if I was RedHat - I would send a public letter to SCO and 
give them a week time frame to show the code. If a week passes and they do 
not show the code - then I'm asking a judge for compensation (think 7 digits 
number)..
