strainge log syslogd connection refused

I been looking and tracing and all that fun stuff, time to call in big boys

redhat 4.2 upgraded to 5.2
and I get 
Jan 23 21:38:18 jerryc syslogd: sendto: Connection refused
in my messages log....

no clues tried tcpdump, checked the config file not a clue

Clueless in KC..
