I'm looking at this even less altruisically than you are.

In using parts of the kernel code Microsoft must publish the source code.  So 
making changes to the kernel and publishing them keeps Microsoft in 
compliance.

While they can still assert their patent rights to keep anyone besides them 
from actually using it.

Of course if the kernel had switched to the new license, they couldn't do 
that.

But that would open another can of worms.
