You're incorrect.

Retreating personnel can be shot at will. Lifeboats with troops can be shot.
These people are running away so that they can return and fight against you
again. The problem arises when someone who has surrendered is killed. Someone
in a lifeboat is more likely to attempt to surrender if given the opportunity,
but it's not guaranteed. To Yzak, it looked as if the shuttle was filled with
retreating military personnel, and thus was a fair target.

What the shuttle crew should have done is to loop a broadcast indicating that
the shuttle was filled with refugees from Heliopolis. If ZAFT wanted to
confirm that, then they could order the shuttle to land on one of the ships in
the fleet where ZAFT could examine the passengers. Once the civilians'
identities had been confirmed, then they could be released.

In the end, though, it doesn't matter if it was civilians or military
personnel onboard. Shooting retreating personnel like that is
strictly forbidden. Those folks in the shuttle would fall under
the same treatment as ejected pilots and people in lifeboats. And
the thing is, Yzak can't even deny that he didn't know since his
flight recorder would have recorded his spew about "Soldiers
shouldn't run away from a battle", or whatever, as he shot them
down.
