By your definition of IRS laws, no non-profits could exist.  Soup
kitchens would be forced to close because they provide the same
services as restaurants.  Goodwill would be shut down because they
provide the same services as clothing retailers.

What is your point here?  I never said that non-profit = saintly.
Let's get real here.  Someone is going to "profit" from any decision
that is made by any "body", whether it be a group of researchers, an
elected board, an appointed board, a group of vigilantes, etc.  That's
life.
