On June 8th,  the California Court of Appeals for the Second
District ruled that hosting a web site with a company whose
servers are located in California is insufficient grounds to
confer Californian jurisdiction over the site. The decision
stemmed from a defamation lawsuit filed against the Jewish
Defense Organization, which in 1997 claimed on its site that
the plaintiff, Steven Rambam, "secretly admires the Nazis and
hates Jews" and "is a dangerous psychopath who tried to kill
his mother."  Rambam sued the New York City-based organization
and its founder, Mordechai Levy, in state court in Los Angeles.
He argued that their contracts with California ISPs GeoCities
and Xoom.com gave California courts jurisdiction.  The court
found that online contracting with ISPs who are California
corporations or maintain offices there does not constitute the
"purposeful availment" required to confer jurisdiction.  The
decision overturned a lower court's ruling. The case, Jewish
Defense Organization v. Superior Court of Los Angeles County.
