They have lower plans that are more inline with DSL prices, and closer

Motorola SB6120 ~$100, but less at times, or pay $7 a month without TV
service to rent one, $3 with TV. Also they charge a bit more for
Internet only service. Which is unlike At&t.

I can't imagine what it takes to trigger that. I do a fair amount of
downloading and such and could be more. But haven't ever gotten near
that to my knowledge. I did have a buddy out in California that got the
letter long ago. But they were being stupid with their activities.
Needless torrents and downloads of stuff, they had no use for. Likely
what brought about such policies.

Then again its also a result of overselling capacity.

I very much agree, there are two costs. The cost of the line, and the
cost of usage, and data exchange with other carriers. The cost for the
line is the same for all, but the usage is surely not. However most all
cellular carriers are moving away from per minute plans to unlimited
plans. Which of course unlimited is not unlimited, at least not with
regard to data. They don't have a cap at this time to my knowledge. But
will throttle you back to slower speeds once you use so much.
