Hi,
It's not there because the app must be running for it to be in the menu bar. If an app is in the dock, it means it's there for you to open. It's like the taskbar over on the other platform.

The menu bar is now the extras menu as of Mountain Lion or Maverix,
can't remember. But it can be accessed with either VO-M-M or Control-F8
