 Campaign: International Isolation of the Torture Regime in Peru


 TO PERUVIAN AND INTERNATIONAL PUBLIC OPINION

 CASE : "HUNGER STRIKE" OF ABIMAEL GUZMN AND OTHER POLITICAL
PRISONERS
VICTIMS OF THE REGIME OF TORTURE AND INHUMAN AND DEGRADING TREATMENTS
IN
PERU

 The Justice International Secretariat calls on Peruvian and
International
public opinion to alert it to the following facts:

 That the current Peruvian regime headed by Mr. Valentin Paniagua
Corazao is
continuing presently to apply in its entirety the criminal policies of
the
previous Mafia regime of Alberto Fujimori. Fujimori is now a fugitive
torturer hiding under the wing of the Japanese government, while his
"adviser" Vladimiro Montesinos, is also a fugitive. According to David

Waisman, President of the Peruvian Parliamentary Commission
investigating
the crimes of the Fujimori Mafia, Montesinos is currently in hiding
and
under the protection of the US government and its Central Intelligence

Agency (CIA). As public opinion is surely aware, Mr. Montesinos has
long
been at the service of the CIA and that is an acknowledged fact.


 These current Peruvian State policies in question were in fact
introduced
under Fujimori precisely under the advice of the US government. These
policies of "low intensity warfare" involve keeping all prisoners
accused of
terrorism before the ?faceless tribunals" (military personnel wearing
hoods
that were instituted in phoney judiciary functions by the Fujimori
drug
dealing Mafia) under conditions that international law condemns as
crimes of
torture, inhuman and degrading treatments, and which are subject to
prosecution and sentencing without prescription, national sovereignty
exceptions or limitations in any country of the world.


 Therefore, the regime headed by Mr. Valentin Paniagua, particularly
its
President, as well as its Prime Minister Mr. Javier Prez de Cuellar
and the
Justice Minister Diego Garcia Sayn, are now offenders under the same
laws
Fujimori was accused of violating shortly before the downfall of his
cruel
tyranny by our Secretariat, at the Audience that took place on
November 15,
2000 at the British House of Lords. (See speech of General Secretary

 Particular notice must be taken that Mr. Diego Garcia Sayan, the
current
Justice Minister under Mr. Paniagua, has been revealed by the former
Fujimori Prime Minister, and current Presidential candidate, Mr.
Carlos
Boloa Behr, as a long time associate of Vladimiro Montesinos and the
Peruvian National Intelligence Service (SIN) Montesinos led until
recently.
The SIN is an institution under the wing of the American CIA, and
whose
inhuman and corrupting activities are just being revealed to the
complete
horror and despair of the entire gamut of Peruvian society.

 In its call for developing the Campaign "International Isolation of
the
Torturers Regime in Peru", issued November 19, 1999, the Justice
International Secretariat said as follows:



 Recently the Paniagua regime issued a Supreme Decree announcing the
"reactivation" of the National Intelligence Service, SIN, the
psycho-social
manipulation and control organ used by the Fujimori-Montesinos Mafia
in
recent years. Since then, in Peru and at the international level we
can
observe a new rendition of the propaganda practices and a reactivation
of
the same instruments formerly used ? in violation of international law
? by
the Fujimori regime itself, evidently in pursuit of similar and maybe
even
more sinister aims of the Peruvian state and its CIA sponsors.


 While the isolation and sensory deprivation regime applied against
Dr.
Abimael Guzman and other prisoners buried in "graves for the living"
within
the Torture Centre located at the Callao Naval Base under the control
of the
Peruvian Navy continues without pause, the Paniagua regime and
particularly
its Minister Garcia Sayan - today in charge of their "reactivated SIN"
- are
evidently moving exactly the same levers Fujimori and Montesinos used
before
to improve upon the performance of the overthrown regime itself.

 Today they are announcing before the world a purported "hunger
strike" by
Abimael Guzman. They are claiming that Mr. Guzman has addressed
Paniagua a
clemency plea and threatens to die by his own hand by means of this
"hunger
strike". This supposed petition is being handled by means of another
functionary of the regime, the so-called "People?s Defender". All this
is
being done hand in glove with those "lawyers" appointed by Montesinos
himself as "Guzman?s attorneys" after his true attorneys were
assassinated
or imprisoned in similar conditions to Guzman, for the "crime" of
attempting
to exercise their professional duties and his rights to a defence
before the
Fujimori hooded tribunal, back in 1993.


 The Peruvian exiled journalist Luis Arce Borja, Director of El Diario

Internacional which is published in Brussels, Belgium, a newspaper the

Peruvian regime has for many years accused and persecuted as the voice
of
Mr. Guzman?s political party, has recently published a statement which
we
reproduce in part below:


 On  The hunger strike of Dr. Abimael Guzmn .
 And the real defence of the life and freedom of the war prisoners.


 1. Via Internet a letter is being circulated. In this letter support
is
requested for  The Hunger Strike of Dr. Abimael Guzmn . This
document is
the work of a so called  Csar Vallejo Study and Work Circle , an
electronic label that is the trademark being used by a number of
police
agents and capitulators in Europe for a number of years. Until
Fujimori?s
downfall, this group was active in promoting and propagandising the
"peace
letters" manufactured by the American CIA and the Peruvian
Intelligence
Service (SIN) with the aim of slandering Chairman Gonzalo (Abimael
Guzman ),
preparing the ground for his assassination and smashing the People?s
War.
The "Cesar Vallejo Study Circle is an umbrella for the activities of
the
head promoters of the Peru People?s Movement who 1993 went over to
work
directly with the SIN then under the regime of Alberto Fujimori and
Vladimiro Montesinos.

 For these same reasons, it does not surprise us that currently this
gentry
are promoting a  Hunger Strike of Dr. Guzmn . Their purpose is
clear and
particularly seeks to continue their work of slander and erosion of
the
prestige of the leader of the Communist Party of Peru, who is now
being
portrayed as a traitor and a common hunger striker. Another evident
objective of these people is to crawl before the new Peruvian regime,
and
further the scheme of  pacification of Peru . It is within this
orientation that the agents and capitulators are demanding from V.
Paniagua
 a government of national unity and reconciliation .

 We like also to stress that the same Diario Internacional has
previously
expressed their belief that this type of psycho-social manipulations
are
aimed either at the present assassination of doctor Guzman and other
prisoners undergoing the same treatment, or at covering up the fact
that Dr.
Guzman may have been already executed without trial by the former
Fujimori
regime.

 The first possibility is that, under cover of this purported hunger
strike - witnessed exclusively by functionaries, agents and Montesinos

appointed "lawyers" under the control of the same government in charge
of
this illegal torture and isolation regime - Mr. Guzman would be
presented
before public opinion as having "unfortunately died due to his serious

medical condition aggravated by his refusal to take his prescribed and
vital
medication as part of his hunger strike " (a concept they are already
bandying about in their publicity, as everyone can see in the Peruvian
and
world media).

 The second possibility is firmly based on the fact that, back in
1993, the
Fujimori regime had approved "in Ministerial cabinet" a secret decree
for
the execution by firing squad of Abimael Guzman, shortly after they
disappeared him from public view and was officially "buried in his
appointed
tomb for the living", supposedly never to be seen alive again.

 After his apparent falling out with Fujimori, Montesinos himself
claimed to
have interceded with his President to spare the life of Guzman during
this
period, while the former Fujimori appointed Prime Minister (now an
indicted
fugitive in Spain) Javier Valle Riestra, has attested as to the
reality of
the existence of the Fujimori signed execution order against Guzman,
the
leader of the Communist Party of Peru, having personally examined the
document. It must be noted here that the death penalty, judicially or
otherwise, is illegal in Peru, under the legislation of the "Fujimori
Constitution" as well.

 Taking into account that Abimael Guzmn has expressed in his writings

before his capture and disappearance his own opposition to the hunger
strike
method as contrary to his own ideology, the version of El Diario
Internacional has weight and deserves credence..

 Another important point to stress before international public opinion
in
particular is as follows:

 The Paniagua regime is itself under question and deeply involved in
the
storm of finger pointing that has flooded Peru as a consequence of the

unbelievable level of corruption and crime in which the fascist
tyranny of
Fujimori had mired the entire political establishment of the country.
Valentin Paniagua, the current president, has himself being accused by
an
associate of Montesinos of having received from him bribes for his own

electoral campaign. This accusation was not investigated ? according
to the
law introduced by Paniagua himself that mandates this kind of
corruption
accusations should be immediately be placed under investigation ? or
even
denied. Instead, a hue and cry of "offended virginal honour" was
accompanied
of mob intimidation which resulted in driving a Peruvian TV
investigative
journalist to flee from Lima under diplomatic protection and to seek
protection in Costa Rica.

 The regime of Messrs. Paniagua, Perez de Cuellar and Garcia Sayan in
Peru,
is currently in contempt of international law, its main
representatives are
in fact known public perjurers having been sworn to defend the 1978
Peruvian
Constitution, and nevertheless ended up by serving in Fujimori?s bogus

parliament, the product of his coup d? etat against that very
Constitution.

 Currently, they in fact have sworn themselves to rule precisely under
the
so-called "Fujimori Constitution", which has been revealed as the
result of
a fraudulent referendum manipulated by the SIN on a gigantic scale.
Such a
regime is certainly in no condition to demand that its word, or that
of its
functionaries at all levels, should be accepted as divine truth,
specially
when they insist in concealing from any independent observer the true
fate
of these prisoners behind the curtain of their illegal isolation
regime,
where no one can see anything else but their word to know for sure
what is
going on behind the thick walls and iron gates of the Torture Centre
of the
Peruvian Navy in the port of Callao.


 Therefore, given that this story of the "hunger strike of Abimael
Guzmn"
continues to be vociferously promoted by the same sources that
Montesinos
used before for his own political ends, it is evident for the
Secretariat of
Justice International that there is a strong possibility that under
the very
noses of world public opinion a sinister plan engineered by the
American CIA
and its "reactivated SIN" surrogate has indeed been set in motion: The

"final solution", under cover of this trumpeted "hunger strike", for
those
prisoners currently subjected to the Torture Regime in Peru, resolving
their
political problems and at the same time erasing their criminal tracks
and
those of their proteges, Montesinos and Fujimori, as well as the
Paniagua
regime.

 We remind our readers that under international law such prisoners as
have
been kept in total isolation under this regime, have the status of
disappeared persons, hostages of the state that refuses them their
right to
be presented before a legally and properly constituted tribunal to be
judged
for the crimes they have been accused of.

 Given the current political upheavals Peru is undergoing, a murderous
act
of this nature would not only constitute a crime against the person of

Abimael Guzmn, but likewise a crime against humanity.

 It is clear that if a plot of this nature were to succeed in causing
harm
or death to this prisoner, such a ?magnicide? (the assassination of a
political leader) would with all certainty result in the exacerbation
of
civil war to unforeseeable proportions. A very dire possibility that
precisely our Secretariat is currently making strenuous efforts to
avert.

 The lives of thousands, maybe hundreds of thousands, or even millions
of
Peruvians and other Latin Americans, may very well hang now on this
balance.
Therefore, it is urgent that the entire democratic movement in the
world be
aware of these facts, and that it would therefore make sustained
efforts to
prevent this eventuality.

 It is under this serious circumstances that our Secretariat now
reiterates
its demand that the current regime in Peru immediately lifts the
illegal
isolation of Abimael Guzman. That they immediately proceed to close
down the
Torture Centre administered by the Peruvian Navy in Callao, and that
all
tortures, inhuman and degrading treatments against all Peruvian
political
prisoners and all prisoners in general, immediately cease in Peru.

 They should immediately restore all public rights and democratic
liberties
suppressed by Fujimori?s fascist regime, abrogate forthwith the entire

illegal edifice of his "legislation" and proceed in accordance to
international law and democratic principles of right with all those
prisoners it keeps as hostages or disappeared, such as Guzman himself
is
kept.

 They should cease all persecutions against all citizens for reasons
of
their ideas, and set free all innocents accused, cancelling all
illegal
warrants of the Fujimori regime and granting all accused the right to
fair
trials, publicly held, with full rights to defence and every guarantee
the
law demands, under the basic principle that all accused are innocent
until
proven guilty before a legally constituted tribunal of law.


 Should they fail to proceed in this fashion, the current rulers of
Peru,
principally Valentn Paniagua, Javier Prez de Cuellar and Diego
Garca
Sayn, who have already incurred responsibility in crimes of torture,
shall
be deemed responsible too for all the consequences their illegal,
contemptuous, and highly dangerous behaviour may result in. And this
includes responsibility for the outbreak of a large scale civil war
that
could not fail to have international repercussions in the area, and
possibly
even beyond. We remind them very specially that this action in itself
does
constitute warmongering, the greatest crime of war, in accordance to
the
Verdict at Nuremberg of 1946.

 !INTERNATIONAL ISOLATION OF THE TORTURE REGIME IN PERU!

 !CEASE TORTURE AND INHUMAN AND DEGRADING TREATMENT ANTES AGAINST
