Possibly, but even if he did get awarded damages I am sure the dealer would appeal. A lot of these cases where you think "Man, I cant believe that someone would get paid out for that!" dont end up getting paid out, like the one where that knob got drunk (in bondi was it?), dived into shallow water and broke his neck - he sued the council, they awarded damage, council appealed and won the damages back. I believe that he may have had to pay legal costs as well.
