(1) The Group of Ministers has decided to drop the Disability Commission from 
the now proposed disability bill.

Kindly note that henceforth I would not call this document as the 'new' law as 
I fondly used to call it earlier. There is nothing new in it anymore. It is now 
the same old same old. We have gone back 20+ years. 

I would also now not refer to this document as the Rights of this and that 
Bill. The “rights” of millions of persons with disabilities have just been 
recklessly taken away by the GoM and each one of us ought to be deeply ashamed. 

Continuing on:

(2) The Group of Ministers has also decided to significantly reduce the number 
of disabilities. Hemophilia, Thalassemia, Sickle Cell Disease, Muscular 
Dystrophy, Multiple Sclerosis, etc to all get dropped or “clubbed”. Whatever 
that means.

(3) This one is devastating. The government is of the view that “mental 
illness” is NOT a disability. That it is a “health issue” and therefore, it 
should be out of the ambit of this law and that it should be left to the Health 
Ministry to “deal” with it. 

I am sending this email to a 100+ people in the Indian disability sector whom I 
know or whom I knew at some point of time. 

As angry as I was and I am with some, I am firmly of the view that everyone 
must know. These developments are far too significant to be ignored. So, I am 
doing my bit. 

What you/they do with this info is entirely upto you/them. Last time I sent the 
below email, one person asked me to drop her from this mailing list! I haven't 
done so. She too must face the cold and bitter truth. 

Each person who opposed the smooth passage of the then RPWD Bill in 2014, must 
now formally hang her/his head in shame. 

My last bit:

Please don't overestimate the Social Media. Facebook, Twitter, taking photos 
with placards hung from the neck is all very cute and very western, but it 
won't get desired results. 

There are two persons atleast who rush off to foreign listservs at the drop of 
the hat. Why wash our dirty linen before foreigners? Please don't do that. 

IN CONCLUSION:

I am personally very hugely dejected. And, at a bit of loss. What to do? Where 
to go? Whom to meet? What will work?

As of now, I will say this. Ho halla, I don't think will help. Do some serious 
thinking. Find out as to who are the people through whom we can reach out to 
the Prime Minister, to Rajnath Singh and to Maneka Gandhi. Explain our point of 
view in a mature, grounded manner and then, wait and see.

The next meeting of the GoM is expected to be on 15th February.

Union Minister Maneka Gandhi who is part of a ministerial panel to examine the 
proposed Disability Bill has raised objections to it saying that the bill does 
not lay criterion for determination of mentally disabled persons.

"It (bill) does not differentiate between mentally ill and mentally disabled 
person. But there is a difference between the two. If a person is mentally ill 
like schizophrenic, how can he be given a job," Gandhi said talking to 
reporters on the sidelines of a function.

According to the present law on disability, three per cent reservation for 
disabled people is mandatory in all categories of government jobs.

The matter was raised in the meeting of Group of Ministers (GoM) which held its 
first meeting today to examine the Right of Persons with Disabilities Bill 2014.

The GoM is headed by Home Minister Minister Rajnath Singh with Women and Child 
Development Minister Maneka Gandhi, Tribal Affairs Minister Jual Oram and 
Social Justice and Empowerment Minister Thaawar Chand Gehlot as its member.

Gandhi said the Bill needs to be worked on further before presenting to the 
Cabinet.

The Bill makes accessibility a mandatory requirement under the law. It proposes 
entitlement for persons with at least 40 per cent disability to certain 
benefits such as reservations in education and employment, preference in 
government schemes, etc.

In the case of a mentally ill person, the district court may award guardianship 
to take care of him and take all legal binding decisions on his behalf in 
consultation with such person.

The Bill was drafted by Ministry of Social Justice and Empowerment and seeks to 
replace the Persons with Disabilities (Equal Opportunities, Protection of 
Rights and Full Participation) Act, 1995.

It imposes a penalty of Rs 10,000 or imprisonment up to six months for 
violation of any provision of the Act.
