protect their work the way Microsoft does. That's a conscious decision on

You mean developers that give away their code /for free/ should pay for
patenting software at $20k+ per patent?  Is that what you're advocating?
They could just as easily release the code under a closed-source model if they 
so chose. It's easily done and doesn't cost $20K to do. But they choose not to, 
for whatever reason (some for technical reasons, some for moral ones, the why 
doesn't matter).

If you release your code under a permissive license, you have to be willing to 
accept that folks might (gasp!) use it, redistribute it, repackage it, etc., 
etc.   If you don't want them doing that, feel free to use a tighter license.

That's the hypocrisy I can't stomach.

Yes-let MS have it, change one iota and patent that to stifle development anywhere else. These are the people that claimed Linux had hundreds of patent infringements, threatened lawsuits and came up with zip. But they tried to clam Linux up because they are afraid of it.
And it did affect companies considering Linux over Windows.
Or, maybe we should let Ballmer have his unlimited "technical immigrants" because "there are not enough qualified people here" so we need cheap-er-qualified foreign programmers.
There ain't no qualified out of work people here, right?
Evil? Nah.
Furthermore, how about EFTPS? Government forcing of accountants and businesses to run Windows for the required online taxes. If they are going to force you into this why not
use a Java program platform independent instaed of a Windows specific POS?
