to make it short: it finally works with a new apache - apache 1.3.20 and
mod_ssl 2.8.4 (i had 1.3.19 with 2.8.3 before)

it is possible - the mod_ssl error is not fatal - it just uses the same
certificate (which in cases of *.foobar.com is an acceptable solution - at
least for me).

i did not have to modify the config file after the update, by the way - it
worked flawlessy.

hey, i am not stupid, ok? :-) if i say i am 100% sure, i am 100% sure :-)
the apache did not complain about it with the freshly compiled httpd, btw.

the only thing i had removed from the compiling was the ipv6 patch - maybe
this confused mod_ssl :-/

regards and thanks for you help,
