It fails the most basic open-source definition, you are not allowed to
modify it nor to redistribute that modification.

The DFSG requires that all shipped files are conform with it. The
specification itself doesn't have to be free, but it's part of the
distribution. RFCs for example are in the same boat with it. You are not
allowed to modify and/or distribute but implement them.
