You're confusion may be because you cut out the rest of my statement.  It IS
illegal to sell them, and it's illegal to pirate official releases, but it's
NOT illegal to tape and trade.  At least in the US, it's legal to tape a
concert, if the band allows it.  It's legal to own a recording of a concert,
no matter whether the concert was legally taped or not.  It's a grey zone in
US law regarding trading such recordings (unless $ is involved, and that
makes it immediately illegal), which is why you have three classes of bands:
   Those that allow taping, but not trading
   Those that allow taping and trading
   Those that don't allow taping or trading
