As I said, I myself even tried to add the "disabled hw IRQ during ->hard_start_xmit()" condition and it failed spectacularly and had to be reverted from Linus's tree the very next day. You simply cannot do it. You'll need to find a way to do netpoll without disabling hw IRQs during these driver methods.
